Right of withdrawal
The customer has the right to withdraw from the contract concluded with the seller, without any penalty and without specifying the reason, within fourteen (14) days, starting from the day of receipt of the purchased products.
To withdraw from the contract, it is necessary to fill out the online return form by logging into the reserved area within 14 days of receiving the order. In order to withdraw from the contract, the customer may also send another declaration clearly expressing their intention to withdraw. If the online return form is used, the seller will send online confirmation of receipt of the withdrawal. If another declaration is chosen, it will be the customer's responsibility to prove the correct exercise of the withdrawal.
Once the withdrawal from the contract has been exercised, the customer is obliged to return the products to the seller by delivering them to the courier for shipment within fourteen (14) days from when the decision to withdraw from the contract was communicated to the seller.
Return shipping is at the customer's expense. Any customs duties are also at the customer's expense and will be deducted from the refund.
The right of withdrawal - in addition to compliance with the terms and procedures described in this article 7, is considered correctly exercised if the following conditions are also fully met:
- the online form was filled out by logging into the reserved area within 14 days of receiving the order;
- the products must not have been used, worn, or washed;
- the identification tag must still be attached to the products, as it is an integral part of the goods;
- the products must be returned in their original packaging, with the original labels, intact security tag, wrappings, and other accessories (dustbag, garment cover, etc.) received in the package; the original packaging of the products must not be used as shipping boxes for returns;
- the returned products must be delivered to the shipper within fourteen (14) days from when the decision to withdraw from the contract was communicated to the seller;
- the products must not be damaged.
If the right of withdrawal is exercised following the procedures and terms indicated in this article 7, Helmè will refund any amounts already collected for the purchase of the products according to the methods and terms provided.
The amounts will be refunded to the customer as soon as possible and, in any case, within fourteen (14) days from the seller's receipt of the returned goods and once the correct execution of the terms and conditions indicated above has been verified.
If the procedures and terms for exercising the right of withdrawal are not respected, the customer will not be entitled to a refund of the amounts already paid to the seller.
Within 14 days from the sending of the email communicating the non-acceptance of the return, the customer may choose to recover, at their own expense, the products in the condition in which they were returned to the seller, by notifying the seller according to the procedures that will be communicated to the customer. Otherwise, the seller may retain the products, as well as the amounts already paid for their purchase.
The refund will be made only and exclusively to the payment method used for the purchase.
Requests for replacement of goods for size and/or color change
Helmè offers the customer the possibility to make replacements for size and/or color change. It will not be possible to request the replacement of an item with different models.
For the replacement procedure, the online replacement form must be filled out by logging into the reserved area within 14 days of receiving the order. Helmè will confirm receipt of the request by email. The replacement form must indicate the different size and/or color requested.
In case of a replacement request, all additional shipping costs will be borne by the customer.
It is not possible to make exchanges for countries that have customs duties.
The terms and instructions on the Right of Withdrawal are pursuant to Legislative Decree no. 21/2014, art.49, paragraph 4.
WITHDRAWAL
The customer has the right to withdraw their order so that it complies with the return policy.
If the customer receives a defective or incorrect order, they are kindly requested to notify us promptly. We will assist the customer to resolve the problem. Helmè reserves the right to request any evidence in order to carry out accurate checks.
NON-DELIVERY
If the order is not delivered for reasons beyond Helmè's control, such as incorrect/incomplete address, recipient absent, or refusal of delivery, Helmè reserves the right to deduct any shipping costs and customs duties from the refund due to the customer.
